FreelanceNation, LLC ("FreelanceNation") is committed to the responsible handling of users' personal information. This privacy policy ("Privacy Policy") describes how we handle your personal information for the services available through www.thefreelancenation.com (the "Site"). By using or registering on this Site, you acknowledge and represent that you have read, understood, agree to be bound by, and accept, this Privacy Policy and expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on July 15th, 2007. Below you will find answers to several questions regarding FreelanceNation's online privacy policy.
1. What information does FreelanceNation collect about you on this Site?
Registration Information.
To become a FreelanceNation user, you must first create an account by registering on this Site. To create an account you will be required to provide a combination of the following contact information: name, email address, street address, city, state, zip/postal code, country, phone number, user name, password, and other requested information. We may, in the future, include other optional requests for information from you, to help us to tailor the Site for you and deliver personalized information to you.
Profile Information.
If you decide to offer a service as a service provider on the Site, potential buyers will look to your profile to help them decide whether to accept your bid for their project. As a result, we suggest that you create a personal profile. FreelanceNation collects personally identifiable information that you provide when you create your online profile describing your experience and qualifications. The personally identifiable information ("personal information" or "your information") collected on this Site can include some or all of the following - graduate school attended, undergraduate school attended, prior work experience, and other similar information. Your city and state location will be included with your profile to allow buyers and service providers to easily locate and communicate with each other.
Since FreelanceNation is in the business of helping connecting freelance professionals with projects using this Site, we give you the option of putting your resume in our database. Personal contact information from your resume will not be shared with anyone outside of FreelanceNation and its authorized agents without your prior permission.
Community and Correspondence.
We collect information relating to community discussions, chats, dispute resolution, correspondence through the Site, and correspondence sent to us.
Financial Information.
We may collect your credit card number and/or other entered financial institution information and will use that information to bill your subscription fees and/or to perform the billing operation on behalf of the service provider, including the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Such information may include information related to wire transfers, ACH transactions, debit cards, or checks.
Feedback.
We may collect information you provide us to improve our service and to provide customer support. We may retain it as necessary to resolve disputes and provide customer support.
Email to Friends Feature.
FreelanceNation lets you easily send project postings to friends via email. FreelanceNation also offers the ability to send friends emails about providing or purchasing services through FreelanceNation. If you choose to use either feature, be assured that FreelanceNation only uses your friends' email addresses on a one-time basis to send the requested posting and we use your email address to copy you on the message or to send on your behalf.
Online Surveys.
Occasionally FreelanceNation conducts an online user survey to collect information about our users' preferences. These surveys are optional and if you choose to respond, your responses will be kept anonymous.
Technical Information.
In addition to the personal information identified above, FreelanceNation also automatically receives and records data from our servers and from your browser when you visit this Site, including your IP address, the time, and information about the page you requested, and the site through which you were linked to this Site, if any. We may use tracking technologies in a variety of ways, including the following: keeping count of return visits to this Site; accumulating and reporting anonymous, aggregate (data collected in mass), statistical information on Site usage; and determining which features users like best.
Cookies.
Your Internet browser has a feature called "cookies," which store small amounts of data on your computer about your visit to our Site. Cookies tell us nothing about who you are unless you specifically give us personal information. You can always choose not to accept a cookie by changing your computer preferences to refuse cookies or to prompt you to accept each cookie, but doing so will limit the range of features available on the Site. You may also elect not to allow cookies to be collected by selecting certain options on your browser.
Log Files.
FreelanceNation logs IP addresses for system administration purposes. This information is used to diagnose server problems, monitor traffic patterns, analyze trends, administer the Site, track member user patterns, and identify the most popular areas of the Site to deliver content most relevant to registered members. IP addresses are not linked to personally identifiable information and are only used to gather broad demographic information for aggregate use, except in the case of fraud.
2. What does FreelanceNation do with the information it collects?
We use your personal information gathered on this Site for a variety of purposes, including (a) to provide the services and customer support you request, including contacting you via email to inform you about updates to our services and providing you with information relating to transactions that you conduct on the Site, (b) to improve various offerings to you, (c) to resolve disputes, collect fees, and troubleshoot problems, (d) to enforce our User Agreement, (e) to tell you about targeted marketing, service updates, and promotional offers based on your communication preferences, and (f) to send you an email to notify you about new services, new features, or ways for you to get more out of our service.
We also may use certain data for administrative and analytical purposes such as information systems management, accounting, billing and audits. We may also use personal information to provide you other services, such as sending you an email notification regarding the status of your account or informing you about special promotions, surveys, or other opportunities from FreelanceNation.
FreelanceNation may enter into co-branding relationships with third-party websites and companies to provide products and services to our users.
3. With whom does FreelanceNation share the information?
Personal information about you as an individual subscriber or registrant may be shared in the following instances:
Third Party Vendors.
FreelanceNation employs third-party vendors, service providers, and suppliers to perform various functions on our behalf for our business operations. Such services include: processing credit card payments, wire transfers, ACH transactions, and similar transactions; analyzing data; developing, hosting and maintaining our Site and databases; sending and receiving e-mail and other communications; and staffing customer service call centers. These third parties may have access to personally identifiable information as reasonably necessary for the third party to provide these services. These third parties are not allowed to use personally identifiable information except for the purpose of providing these services.
Compliance with Law and Protection of Rights.
FreelanceNation may disclose the information to third parties in connection with a court order, subpoena, government investigation, or when otherwise required by law. FreelanceNation may report to law-enforcement authorities conduct it believes may be unlawful, and may release to such authorities personal information relating to such suspected unlawful conduct. FreelanceNation may release some or all personal information if necessary to protect FreelanceNation's rights or property or to protect the safety of FreelanceNation's employees or others. FreelanceNation may release personal information as part of the dispute resolution process under the Site.
Organizational Changes.
If FreelanceNation undergoes a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation, FreelanceNation's accumulated customer information will be treated as an asset and, like other business assets, subject to transfer to or acquisition by a third party.
Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are bidders, buyers, or service providers on our Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the information you disclose to them. Since FreelanceNation does not control the privacy policies of third parties, you are subject to the privacy policies of those third parties. We encourage you to ask questions before you disclose your personal information to others.
FreelanceNation also shares the information it gathers in a compiled format with advertisers and other partners. The compiled format does not include personally identifying information.
4. How do I correct or update my personal information?
You can correct or update information previously submitted to FreelanceNation by visiting FreelanceNation.com and providing us with the updated information. In addition, you can choose not to receive further electronic communications from us. To do this, simply follow the URL provided at the end of each electronic communication you receive on our behalf and request the deactivation of your information from FreelanceNation's database. This can also be completed through your Profile Administration page.
5. How does FreelanceNation protect the security of my personal information?
FreelanceNation will use appropriate security measures to protect your information in a secure, controlled environment (e.g., encryption, passwords, physical security, etc.). FreelanceNation has made substantial investments in server, database, backup, and firewall technologies to protect the security and integrity of your information. When you submit sensitive information to FreelanceNation, we protect the transfer of that information with industry standard encryption technology. FreelanceNation is designed so that all transactions performed through FreelanceNation.com are conducted in a Secure Socket Layer (SSL) session. However, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we will use reasonable efforts to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us.
Your password is the key to your account. Use unique numbers, letters, and special characters and do not disclose your FreelanceNation password to anyone. FreelanceNation is not liable for loss of passwords due to user carelessness. If you lose control over your password, you may lose control over your personally identifiable information on this Site. Therefore, if you believe that your password has been compromised, we recommend that you immediately change your password.
As you probably know, despite our use of industry standard security technologies, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the Site. If a security breach does occur and your information is acquired by an unauthorized person, we will take appropriate steps to contain the breach and to notify you of the unauthorized acquisition.
6. Does FreelanceNation's Site link to other Websites?
Yes. This Site provides links to other websites that are not owned or operated by FreelanceNation. Please note that when you click on one of these links, you are entering another website. Such websites are not subject to FreelanceNation's Privacy Policy. Accordingly, you should consult the privacy policies of those websites, if any, prior to entering any personal information on those websites.
7. What is the effective date of FreelanceNation's Privacy Policy and how will FreelanceNation notify me of changes to its Privacy Policy?
This Privacy Policy is effective as of July 15th, 2007. Any material changes to this Privacy Policy will be posted on this Site. We may amend this Privacy Policy at any time by posting the amended terms on the Site. All amended terms automatically take effect 30 days after they are initially posted on the Site. We recommend that you review this Privacy Policy periodically so that you are aware of any changes.
If we decide to use personally identifiable information in a manner different than what was stated at the time of user registration, we will notify members via email at the last email address that you provided us, and/or by prominently posting notice of the changes on the Site. However, it is your responsibility to check this Privacy Policy periodically for changes. Any changes in how we use your personal information will be effective upon the earlier of 30 days after our dispatch of an email notice to you or 30 days after our posting of notice of the changes on the Site. Please note that, at all times, you are responsible for updating your personal information to provide us your current email address. If the last email address that you have provided us is not valid, or for any other reason is not capable of delivering to you the notice described above, our dispatch of the email containing such notice will nonetheless constitute effective notice of the changes. 8. How does FreelanceNation handle children's privacy online?
FreelanceNation's Site is intended for a general audience. FreelanceNation does not knowingly collect personal information about children or enter into transactions with children. In accordance with the Children's Online Privacy Protection Act, FreelanceNation does not permit registration by, and will not knowingly collect or use personal information from, anyone under 13 years of age. If FreelanceNation is notified that it has inadvertently collected personal information from anyone under 13 years old, it will destroy such information.
9. How do I contact FreelanceNation?
FreelanceNation, LLC constantly seeks to improve the quality of the services we provide and the User experience on the Site. We value your input and encourage you to help us expand and make improvements to the Site by providing us with any thoughts or comments you have regarding our services or the operation of the Site. You can submit any comments you have to us by clicking on the link "Email Us" at the top of most of the pages on the Site. The "Email Us" page asks for your email address and Username. Your Username is optional. Submitting comments via email will not cause you to receive any secondary or promotional material, unless specifically requested by you. In certain circumstances, we may ask for your permission to post your comments in marketing or promotional materials.
